General terms and conditions of sale and delivery:

Cancellation rights

You have the right to cancel your order within 14 days without having to provide a reason for the cancellation.

The cancellation period of 14 days begins on the day you acquire the material possession of the goods or a third party indicated by you, other than the carrier, acquires the material possession of the goods.

To exercise your cancellation rights, please take the following steps:

Inform us by means of a clear declaration about your decision to cancel the order (e.g., by sending a letter in the post, a fax or an e-mail). You may use the sample cancellation form found in the downloads section on this website for this purpose, though there is no obligation to use this.

You may fill out the sample cancellation form and send this to us in an e-mail or use another means of clear declaration and send this to us using this website. If you do take advantage of these options, you will promptly receive notification (e.g., by e-mail) as confirmation of receipt of your intention to cancel the order.

Sending your declaration of cancellation before the expiry of the cancellation period is sufficient for complying with the cancellation deadline.

Consequences of cancellation

If you cancel this contract, we are obligated to repay all payments that we have received from you, including the delivery costs (with the exception of any additional costs resulting from your having chosen a delivery method other than the cost-effective standard delivery offered by us), without delay and no later than within 14 days of the day on which we received the declaration of your cancellation of this contract. We will employ the same means of payment for this repayment as that chosen by you for the original transaction, unless something different has been expressly agreed with you; in no case will you be charged for this repayment. We may refuse to make the repayment until we have received the returned goods or you provide evidence that you have sent the goods back, depending which point is earlier.

You must send back or hand over the goods immediately and in any event no later than within 14 days of the day on which you notify us of the cancellation of this contract. The deadline will be deemed met if you return the goods prior to the expiry of the period of 14 days. You will be liable for the direct costs of the return of the goods.

You will only be liable for any decrease in value of the goods if this decrease in value is due to actions taken by you that were not necessary in order to examine the quality, features or functionality of the goods.

End of the cancellation policy

The right of cancellation does not apply to contracts for the supply of goods produced according to your specifications or clearly tailored to personal needs or which, by reason of their quality, are not suitable for return or may spoil quickly or whose expiration date would be exceeded, or for the delivery of sealed goods that for health or hygiene reasons are not suitable for return where the seal on the packaging has been broken after delivery.

Shipping for end consumers or private customers

In the case of defects to our goods, we will be liable in accordance with the statutory regulations.

When sending with the post, days of shipment are Tuesday to Thursday. When sending with express delivery, days of shipment are Monday to Thursday. Express delivery from Friday to Saturday is possible for an additional charge. Cash on delivery is also possible for an additional charge. The goods are shipped in accordance with the shipping information after receipt of payment. A deposit is required for polystyrene winter packaging. Prepaid return labels are provided with this packaging and, after it has been returned, your deposit will be refunded in the form of a credit note that may be used towards your following order.
In the case of transport damages, the transport company will be held liable. Complaints can only be submitted in writing on the day of receipt. We retain the right to return shipment. All costs incurred from replacement deliveries are to be paid by the recipient. The duration of DHL postal shipments and live arrival of the insects cannot be guaranteed and we do not recommend shipping to parcel stations. If the delivery time is exceeded for express deliveries and the goods have perished, the transport company must be notified of this immediately. In this case, the goods are insured if the recipient has the damage documented in a record kept by the delivery agent. A copy of this record must be sent to us. Complaints regarding the delivery of your goods must be made on the day after delivery at the latest. We do not recommend shipping live insects when outside temperatures are under 0°C and above 25°C – deliveries requested under these circumstances are at your own risk. Orders are processed as quickly as possible in all weather conditions. If necessary, orders can be postponed if, at the time of your order, you consider the temperature to be unsuitable. Please contact us by telephone or e-mail for a no-obligation consultation. Shipping to DHL parcel stations is not recommended because they are not temperature-controlled.
Subscription orders during the winter months are only discontinued at your request. Please contact us regarding the return or exchange of accessories prior to shipping these. To facilitate processing, please only use the parcel stamps and complaint forms from fauna topics for return shipments. Costs incurred from retuning products with a value of up to €40 are to be paid by the customer. All costs incurred from DHL delivery failure because of a fault on the part of the customer, such as the provision of an incorrect address, or failure to collect the goods on time resulting in their return shipment, are to be paid by the customer in addition to possible transaction fees.

Shipping for resellers or retailers

Outgoing days of shipment are Monday to Friday. Please note that Fridays can only be considered a day of shipment for express shipments of food insects for Saturday delivery. Please find the cost of shipment in your offer. A deposit is required for polystyrene winter packaging. Prepaid return labels are provided with this packaging and, after it has been returned, your deposit will be refunded in the form of a credit note that may be used towards your following order.

Subscription orders during the winter months are only discontinued at your request. The place of fulfilment for both parties to the contract is Marbach/Neckar, Germany.

Collection

All warranties expire when the insects have been collected from our business premises. The collection times for commercial customers are Tuesday to Friday between 9 am and 5 pm. Alternative collection times can be arranged by prior agreement.

Payment

Delivery is only effected after confirmation of payment by direct debit, payment via PayPal, advance bank transfer or cash on delivery. The goods shall remain our property until all payments have been settled in full.

Reseller customers

Please note that the retail of Lucky Reptile Products online and at stock exchange markets must be approved by the manufacturer. Further information about this can be found at www.luckyreptile.com. If you are importing the goods from abroad, please ensure that you observe your national laws and regulations regarding importation. Product descriptions and quantities of packaged live insects can be found in our online shop. We do not assume liability for the accuracy of the information provided by the manufacturers of the products we sell. This information is subject to errors and alterations at short notice.

Place of jurisdiction

In the case where the purchaser is a merchant, a corporate body under public law, or a special fund under public law, our place of business will serve as the place of jurisdiction. This applies even in cases where the purchaser has no general domestic place of jurisdiction, or where, at some point in time after concluding the contract, he or she transfers his or her domicile or habitual residence abroad, or where, at the time of legal action being brought, his or her domicile or habitual residence is not known. We are also entitled to bring an action at a court which shall have jurisdiction over the purchaser’s place of business, in cases where the purchaser is a merchant.
